MORTIMER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT MORTIMER WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT — INCLUDING AI-GENERATED CONTENT — WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORTIMER TAROT LLC AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF MORTIMER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF MORTIMER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Mortimer Tarot LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and Mortimer Tarot LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Mortimer (a "Dispute") will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small claims court. This arbitration agreement is governed by the Federal Arbitration Act.
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in Virginia or another mutually agreed location, or, at your election, by telephone or based on written submissions.
YOU AND MORTIMER TAROT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
You may opt out of this arbitration agreement by sending written notice to support@mortimertarot.com within 30 days of first accepting these Terms, stating your name and that you opt out of this arbitration provision. If you opt out, neither you nor Mortimer Tarot LLC will be required to arbitrate Disputes with the other, but all other provisions of these Terms will continue to apply.
Either party may bring a qualifying claim in small claims court, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
These Terms, and any Dispute not subject to arbitration above, are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles.
If you downloaded Mortimer from Apple's App Store, the following additional terms apply and take precedence over any conflicting provision in these Terms:
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mortimer Tarot LLC regarding Mortimer, and supersede any prior agreements.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, financing, or sale of assets.
By using Mortimer, you consent to receive communications from us electronically, including by email, in-app notification, or other electronic means. You agree that any notices, disclosures, agreements, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
We may update these Terms as Mortimer changes. When we make material changes, we may provide notice through the Service or another appropriate method. Continued use of Mortimer after changes take effect means you accept the updated Terms.
